Terms of Service

These terms are the agreement between your organization (“you,” the “agency”) and MortonApps LLC (“we,” “us”) for the use of Care Roster at careroster.org. We have written them to be read, not skimmed past; they are short, and we mean what they say.
1. Agreement to these terms
By creating a workspace, signing in, or using Care Roster, you agree to these terms on behalf of your organization. If you do not agree, do not use the service.
2. The service
Care Roster is a shared contact directory for care agencies (hospice, home health, senior care, and assisted living teams) to organize vendors, partners, clinical contacts, community resources, and on-call contacts in one shared, searchable directory. It is an operational companion to your EMR, not a replacement for it, and it is deliberately designed to hold no patient information of any kind.
3. Free trial, plans, and billing
- Trial: new workspaces start with a free 45-day trial that includes every feature. No credit card is required to start.
- Plans: after the trial, continued full use requires a paid plan, priced by the number of user accounts on your agency, in two flat bands: $1,200/year or $120/month for agencies with fewer than 150 users, and $2,400/year or $240/month for agencies with 150 or more users. Every plan includes a login for everyone on staff, with Admin, Editor, and Viewer roles.
- Launch pricing: accounts created on or before December 31, 2026 that subscribe before their trial ends receive our launch rate of $600/year or $60/month under 150 users, or $1,200/year or $120/month at 150 users and over, which stays fixed for as long as the subscription remains active.
- Billing: paid plans are processed by Lemon Squeezy, our merchant of record. Your payment details are held by Lemon Squeezy, not by us. Subscriptions renew automatically at the published price for the term you chose (monthly or annually) until you cancel. You can update your card or cancel at any time from Settings → Plan & Billing, which opens Lemon Squeezy's secure customer portal.
- Emergency texting: each plan includes a yearly allowance of staff text messages (5,000 under 150 users, 20,000 at 150 and over). Texting is intended for urgent operational notices; as a guide, up to 10 alerts per staff member per month. Sends beyond the allowance are not blocked, and we may contact agencies whose use regularly exceeds it about a suitable plan. A message that asks recipients to confirm uses one additional text from the allowance for each person it is sent to, whether or not they reply.
- Plan changes and refunds: plan changes are prorated. We do not issue refunds for unused time; unused time becomes credit on your account.
- Lapse: if your trial ends without a subscription, or a subscription lapses, your account becomes read-only: you can still sign in, view your records, and export your data. Nothing is deleted automatically, and you can activate again anytime to pick up where you left off.
- Price changes: if we change prices, the new prices apply only after notice to you and never retroactively.
4. Acceptable use
You agree to use the service only for lawful purposes, and specifically agree not to:
- Enter patient information. This is a hard term of service, not a suggestion: no protected health information (PHI), no patient names or identifiers, no clinical details, anywhere, including notes and free-text fields. The product is designed without patient fields, and keeping it PHI-free is what allows it to operate without a HIPAA BAA.
- Attempt to access another agency's workspace or data, probe or breach tenant isolation, or circumvent authentication or access controls.
- Interfere with or disrupt the service, or use it to send spam or unlawful communications.
- Resell or sublicense the service without our written agreement.
If patient information is entered despite this term, we may remove it and will notify you; repeated or willful violations are grounds for suspension.
5. Your responsibilities
- Provide accurate account and agency information, and keep it current.
- Have a lawful basis for the contact information your agency enters into the service; those records are yours, entered at your direction.
- Keep your accounts secure: protect passwords, use the role system appropriately (Admin, Editor, Viewer), and remove access for people who leave your organization.
- Tell us promptly at [email protected] if you suspect unauthorized access to your account.
6. Your data
Your agency owns its data. We claim no ownership of the records you enter. You can export everything to CSV at any time, and you can request complete deletion of your account and data by emailing [email protected]. We process your data only to provide the service, as described in our Privacy Policy; we never sell it, never use it for advertising, and never use it to train AI models.
7. Availability and disclaimers
We work to keep the service fast and reliable, but Care Roster is provided “as is” and “as available,” without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted or error-free operation. We recommend exporting your data periodically; the CSV export exists for exactly that reason.
8. Limitation of liability
To the maximum extent permitted by law, MortonApps LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total liability for any claim arising out of the service is limited to the amount you paid us for the service in the 12 months before the claim arose (or $100 if you have paid nothing). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
9. Suspension and termination
You can stop using the service at any time, and you can request deletion of your data as described above. We may suspend or terminate access for material violation of these terms (most seriously, entering patient information or attempting to breach tenant isolation) after notice where practical. Except where data is removed at your request or for a legal requirement, termination does not erase your data: lapsed and terminated accounts retain export access per Section 3 unless the violation makes that unsafe.
10. Governing law
These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Any disputes will be resolved in the state or federal courts located in California.
11. Changes to these terms
If we change these terms, we will update the date at the top of this page, and for any meaningful change we will notify active customers by email before it takes effect. Continued use after the effective date means you accept the updated terms.
12. Text messaging (SMS)
Care Roster includes an optional emergency texting feature. An agency that turns it on can send urgent operational, non-marketing text messages to its own staff: an emergency closure, a severe-weather delay, a coverage change, or another urgent operational notice. A text goes out only when an authorized person at the agency sends it from within Care Roster, apart from the one-time welcome text described below. Care Roster never sends marketing texts.
- Who sends, and from where. Messages are sent by Care Roster on the agency’s behalf from the toll-free number +1 888-459-0727. Every message begins with “Care Roster” and the sending agency’s name, and ends with opt-out instructions. The first time a number is set up to receive an agency’s texts, it gets a one-time welcome text explaining what these alerts are, that message frequency varies and message and data rates may apply, and how to reply HELP or STOP. Welcome texts are sent on weekdays during business hours in the agency’s time zone and do not count toward the texting allowance.
- Work phones. An agency may text the work mobile numbers it provides or designates for its staff. Before any text is sent, the agency confirms within Care Roster that it has the authority to agree to these messages for those numbers, and it is responsible for that confirmation being accurate.
- Personal phones. A personal mobile number receives texts only if the person it belongs to opts in themselves, either when prompted after signing in to Care Roster or on our text opt-in page. An agency can remove a person’s opt-in but can never opt anyone in. Agreeing to receive texts is never a condition of employment, volunteering, or receiving services.
- Confirmation requests. When sending, an agency can ask recipients to confirm they received the message. That message asks the recipient to reply, and any reply counts as a confirmation unless it contains the word “stop”. We record only that a reply arrived and when. We do not store or show what the reply says, and a confirmation gets no response.
- What to expect. Message frequency varies with events at your agency and is usually low. Message and data rates may apply, charged by the recipient’s mobile carrier.
- Opting out. Reply STOP to any message to stop receiving texts at that number; any reply containing the word “stop” counts the same way. Opt-outs take effect immediately, apply to every agency on Care Roster, and cannot be overridden by an agency. Reply HELP for our support contact, or email [email protected]. Other replies are not read or answered; for a message that asked for confirmation, only the fact and time of the reply are recorded.
- No sharing. We never sell, rent, or share mobile phone numbers or SMS consent information with anyone, and never use them for our own marketing. They are used solely to deliver the agency’s own messages. See our Privacy Policy.
